There are murals of inspired souls, touched by a hand guided by forces unknown; of vaulted ceilings and high arches, and mosaics which are crafted, painted and tediously combined; and as one approaches such architectural wonders, the eyes are lifted upwards toward the heavens in such a natural order of elevation that there is no pause for self-consciousness.
Contrast that to the technology of modernity, where huddled masses with sauntering forms and stooped shoulders look down upon the glare of Smartphones, Tablets and the keyboard of laptops; the eyes never wander but within the confined parameters of a rectangular screen, and only in furtive movements of quickened and imperceptible annoyances.
The irony, of course, where the two intersect — the grandeur of architectural brilliance with the future of technological acumen — is when the tourist brings the Smartphone with the self-contained video and camera apparatus in order to gawk at the Medieval Renaissance of antiquity, but never views with the naked eye, but always through the lens for Instagram and Facebook positing. It is, ultimately, of our posture which is most telling, and that which draws the human eye — in a downward trajectory, or with an upward inspiration.
Once, we used to build for eternity and the heavens, whereas of today we huddle in forlorn consternation over glowing screens which dull the mind and blind the eye to the created world around us. And what of other elements in our lives? Do they uplift, or denigrate such that we become downtrodden specimens of another’s playful cruelty? Does the place where we spend the most time draw us as an architect of awe, or diminish the soul by whips and partial tears?
Work — that place and endeavor which occupies the majority of our time — should always lift up, and never demean; and like human relationships of linear poses (unlike the vertical one with gods and angelic superstitions), the combination should always aggregate to a greater quantity than the quality of singularity.
That is why, for Federal employees and U.S. Postal workers who discover that the present situation they find themselves in has become untenable because the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal positional duties, and such a state has engendered resentment, denigration and an opposition to constructive advancement, preparing an effective Federal Disability Retirement application to be submitted to the U.S. Office of Personnel Management, becomes the preferred alternative to continuation in the present state of despair.
Going out on an OPM Disability Retirement for the Federal employee or U.S. Postal worker is never the first choice, and may in fact be the last; but the option is almost always one based upon the survival of the soul, where the architect of awe is no longer present in a world which has seemingly abandoned its teleological relish for life, but where work has come to represent harassment, denigration and demeaning anguish, and where the choices have limited the fragile compartment of the soul and thus the alternative is to suffer silently in a world gone mad and maddeningly unsympathetic to the plight of that traveler whom no one has invited from the coldness of the world.
Sincerely,
Robert R. McGill, Esquire

It is a purgatory of sorts; of the netherworld where twilight is a constancy of confusion, and when neither dawn nor dusk, between summer and winter, or of cognitive clarity and conundrums of confusion reach the pinnacle of an infinite maze. Do we prefer clarity to confusion, or the light of dawn to a period “just before”, when consciousness of thought is suppressed or prevented by a darkness befalling thoughtful perspectives impeded by streams of dancing oracles upon a seamless stupor?
It is often uncertainty which tires the soul. For, while wealth is preferable to destitution, and employment to its opposite, it is being caught “in-between” which engenders uncertainty and angst of future plans, and that is likened to a form of hell.
When a Federal employee or a U.S. Postal worker first learns of a medical condition — whether from an accident or injury on the job, or during a foray into uncharted recreational activities, it matters not for purposes of meeting the criteria for eligibility in a Federal Disability Retirement application submitted through the U.S. Office of Personnel Management — the weariness of time and the toll of uncertainty is often worse than the failure of resolution encountered through therapy, medication regimens, surgical intervention and the long delays in recuperation and rehabilitation.
It is that “waiting” which becomes the agony of life, for the questioning and incessant pondering resulting therefrom haunts the soul: What will the future hold? What will my job do? What are they planning? The “what”, the “when” and the ultimate “why” becomes a reverberating echo of repetitive songs unwavering in their monotony of questions forever unanswered. For, it is the unanswered question and the unstated discretion of silence which makes for waiting to be just another agony of life’s challenges.
To be caught in the world “in-between”, where future plans are delayed because the present remains in a muddle of soft mush, and when past actions fail to concretize a pathway for mapping current stability, is a state of existence which is tantamount to a purgatory of eternal uncertainty.
For Federal employees and U.S. Postal workers, it is thus important to take some action and begin the process of filing for Federal OPM Disability Retirement. Wishful thinking will not make the medical condition go away; and while hope is always a basis for future planning, one often knows early on, within the core of one’s soul, whether the injury or medical condition which prevents the Federal or Postal worker from performing the essential elements of one’s positional duties will resolve to an extent possible in order to return to full duty.
It is not knowing which is the true hell of existence; and to remain caught in the world in-between is often a choice — albeit a bad one — which is based not upon want of certainty, but enmeshed in the essence of human tragedy, when delay prevented that split-second decision that could have avoided the disaster.
Sincerely,
Robert R. McGill, Esquire

Static constancy is never a certainty; even those things which we would bet our lives upon, change with the cultural winds of time.
Sports phenomena we once marveled at, now considered to be “immoral” to view as entertainment, as voluntary brutality and concussions resulting therefrom reflect our relative lack of empathy and humanity; the ravages of time and the images of heroes in old age who totter between dementia and decrepit shadows of a hollow former self; do we see in them the future of ourselves, and fear that if we applaud such former feats of gymnastic fluidity and beauty of ballet, we may end up like them in nursing homes smelling of formaldehyde?
Or is it that the disharmony between what we remember of their once-favored status conflicts with our image of civility and symphony of time? Football and boxing, like the old Roman coliseums of yesteryear, will they fade into the passing glories as gladiators and spectacles of public hangings once foreshadowed? Or, is it that cultural values change, are malleable, and shift with the tides of opinions and public shame?
That is the macro scale of life in America; on the micro scale of things, medical conditions tend to do the same thing: the change in one’s personal universe, the outlook upon perspectives once maintained, they all bend like the proverbial willows of rustling prairies, where the arctic blast which pushes the rogue bison to seek the protection of the wandering herd bellows from harkened cries of alarm to survive.
Life is rarely as bad as we feel, and never as good as we imagine; that is a truism which allows for the maintenance of the balanced perspective. Loss of constancy and stability often follows from a trauma unwanted and unasked for; the Federal employee and U.S. Postal worker who suffers from a medical condition must suddenly suffer the fool for society’s uncaring ways. The potential loss of job; the ostracized Federal or Postal worker — not through fault or inaction, but merely because one has been hit with the misfortune of a medical condition.
Again, is the treatment rendered because the Federal agency or the U.S. Postal Service sees such an individual as a threat, as acceptance and embracing of such a condition would mean that everyone affirms the future of one’s own fragile and delicate universe?
For the Federal and Postal worker who suffers from a medical condition, the solution remaining is often to prepare, formulate and file an effective Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal employee or U.S. Postal worker is under FERS, CSRS or CSRS Offset.
It is not that, given half-a-chance, you wouldn’t be able to continue performing in the career of your choice; you would. It is that, if the agency or the U.S. Postal Service were to attempt to accommodate you, or to provide leeway and reveal a level of compassion and empathy, then it would mean an admission of the deep-seated fears and open the proverbial floodgates of doubt and error.
To embrace the disabled work on the micro scale of life, would be to admit to the callous nature of one’s being on the macro level of culture; football, boxing, gladiators of yore, and the shunning of disabled workers are all likened to the populous who once suffered the ostracizing disease of leprosy. Skewed perspectives, indeed, as culture never follows the linear path of legitimacy, but drags people screaming and kicking despite themselves.
In the end, one must act beyond mere perspectives, and for the Federal and Postal worker who suffers from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s positional duties, the pragmatic step in preparing an effective Federal Disability Retirement application is the singular act of courage to step beyond the macro-skewed perspective of cultural malleability, and to assert one’s right to attain that level of security on the micro path of viability, as those gladiators of yesteryear failed to conquer.
Sincerely,
Robert R. McGill, Esquire

The “what ifs” of life tend to predominate; then, from the deep recesses of brute carnality, where evolutionary Darwinism remains wired in the DNA of a time when civilizations were yet to flourish, and where tea cups were merely in the imaginations of more genteel souls, a sense of uprightness, fortitude and strength of inner character dawns, and we walk out the door refreshed with a sense of deliberative purpose. But it turns out that such fleeting flourishes of fortuitous firmness lasts but for a twilight, and then we desire to crawl back into the womb of our former skeletal selves.
Fear is how most of us live, despite the outward face of bravado and confidence. We fear what others might do to us; how the economy is a mysterious force over which we have no control; of deteriorating health; of life itself.
Then, there are days when a calm sense of overconfidence prevails; without any reason or rationale, or perhaps we watched a movie or television show where a certain character manifested a bright and hopeful sunshine of unperturbed calm; but that was yesterday, and lasted but for a fortnight of winks and nods. For the remaining days, we recognize that it was all an act; and so we live in trembling and fear.
For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition begins to impact the Federal or Postal employee’s ability and capacity to perform the essential elements of one’s Federal or Postal position, that placement on the spectrum between fear and overconfidence is well know, recognized, and familiar as the warmth of a mother’s caress.
What the agency will do; what coworkers conspire; what the next news of the deteriorating medical condition; these all fall in favor of the “fear” side of the spectrum. Those “other” things which call for confidence in the future over and beyond — they come in a spatter of popping grease, and make us wince with the momentary pause of a tap of reality, and then disappear.
How does one escape that spectrum of unrelenting reminders? For the Federal employee and U.S. Postal worker, there is always the option of filing for Federal Disability Retirement benefits with the U.S. Office of Personnel Management. Obtaining a Federal Disability Retirement annuity is not merely a benefit to be gained; rather, it is an opportunity to take the next step in life, to a beyond where future career and vocation choices may allow for productivity outside of the Federal Sector.
Thus, for the Federal or Postal worker who is under FERS, CSRS or even CSRS Offset, preparing, formulating and filing for an effective OPM Disability Retirement application is the first step towards taking a turn away from the treadmill of that dreaded pinpoint of our lives, where we are stuck in the middle of the spectrum between fear and overconfidence.
Sincerely,
Robert R. McGill, Esquire

Does the palm reader tell from lines deepened and extended by time, or in the creases of birth and predetermined fate? Do the ruts and chasms criss-crossing like doodling designs created by a madman mixing a cauldron of witch’s brew depend upon fate already set, or can the future be altered by choices one foresees? And what of the face — the creases around one’s mouth, the ruts above the furrowed brow, or the fine filaments of timeless cuts around the eyes; do they tell a story of joy and promise, or of sadness and sorrow?
The furrowed face is but a moment’s expression; it is rather the corrugated painting, forever captured in the stitch of life’s experiences, which lasts in timeless bottles of floating memories, like butterflies caught in a web of deception where promises of boundless expectations and revelations of hope as sung from the loving tongues of mothers dreaming of tomorrow’s future for children yet unborn.
Time, experience, and confrontations of life tend to deepen the furrowed face of age. As do medical conditions. It is when the tripartite combination coalesces, that decisions need to be made, lest extinguishment of life become the goal of sorrow. For, when a medical condition comes to the fore, it impacts one’s capacity and ability; when capacity and ability become impacted, then one’s work suffers; and when one’s work begins to suffer, the notice of employers, coworkers, and the Federal agency or the U.S. Postal Service begins to turn on its engine of harassment and adversarial modalities of meddlesome trickery.
Federal agencies and the U.S. Postal Service care not whether the ruts and grooves of the furrowed face deepen by the actions of an uncaring bureaucracy.
As Americans spend billions each year on health care and cosmetic products to enhance beauty and delay the inevitable lines of age, so it is often the best medicine to alter the predetermined fate of time by considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, when the furrowed face of life requires such a step. Adulthood rarely spares any of us from the deep ruts of facial scars; and when there is a “baby face” in middle age, it often reflects deeper chasms and valleys within the psyche, where hidden traumas are screaming to be let out.
Federal and Postal employees who face the problems of work because of a medical condition have the option of filing for Federal Disability Retirement benefits through OPM, and begin planning for another stage of one’s life in the private sector. Not everyone has such an option or an opportunity in the face of a medical condition which robs the Federal or Postal worker from continuing in one’s chosen career, but OPM Disability Retirement is that rare benefit which allows for further employment while receiving an annuity.
In that sense, the furrowed face need not be the last and frozen picture of a person’s future, and the palm reader may yet be tentative in predicting the final chapter of one’s life.
Sincerely,
Robert R. McGill, Esquire

The dividing line itself may be a false option; for, there may well exist a spectrum of alternatives prior to falling off of the fathomless cliff into the netherworld of the opposite. Yet, human behavior often reveals to us the tenuous hold we have upon this thin reed we identify as the “civilized” world, where conformity to standards of behavior are relatively followed, and the social contract between citizens constrains open aggression towards one another; and from the individual’s viewpoint, the internal mechanism of orderliness remains fairly intact.
We recognize, however, that there exists such a dividing line; how else to explain the rise of dystopian novels and movies depicting the quick regression into chaos and madness? Then, on an individualized scale, the daily pressures, the stresses encountered, the bombardment of data, needless and useless information, and the constant obsession with our Smartphones — we come to believe that the demarcation is between sanity and the “other” universe, comprised of complete loss of rational discourse.
That is why we come to accept that a person has “snapped” or “gone postal“; and the new normalcy includes a bomb being set off in a crowded mall, and certainly for some endangered countries and populations, that is a daily occurrence to be expected, like birth, death, taxes and sweaty palms on a first date of teenage romance.
Federal employees and U.S. Postal workers who must work under conditions of daily and almost intolerable levels of stress, well comprehend the plight of that fragile decomposition of demarcations. For, when a medical condition begins to impact the Federal or Postal employee’s capacity and ability to continue performing all of the essential elements of one’s positional duties in the Federal agency or the U.S. Postal Service, the exponential quantification of stress levels begins to expand and show the almost-imperceptible cracks opening the inner resolve to “tough it out“.
The question is: How long does it take, and not “whether”, but “when”? The reason why the little old lady next door always says to the reporter, “He was such a nice young man…” is that we rarely take the time to notice the subtle changes of decomposition. Instead, we tend to observe things in incremental jumps, like warp speeds of bouncing into another universe of experiential encounters, instead of being watchful to daily needs and wants.
For the Federal or Postal employee whose medical condition has come to a point where it becomes clear that simply “existing” as opposed to “living” has become a daily reality, the time may be now that preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management has become a necessity, and not merely a theoretical option for an obscure future event.
The dystopian universe first begins with the demarcation between sanity and reality, and the failure to recognize and identify the source of deterioration; rarely is it between sanity and its opposite, except perhaps in timeless tunnels of inchoate universes where the whispers of crying fears shout out in chasms of darkness, in a madness we are creating daily for ourselves as we delay the inevitable.
Sincerely,
Robert R. McGill, Esquire

Federal Disability Retirement is a benefit that is available under the Federal Employees Retirement System (FERS) for all Federal and Postal employees. It is a benefit which is accessible after a person has reached 18 months of creditable Federal Service. I am an attorney who practices exclusively in fighting for Federal and Postal employees to obtain Federal Disability Retirement benefits.
Many people confuse Federal Disability Retirement with “Social Security Disability”, or with Worker’s Compensation benefits. FERS Disability Retirement is distinct and different from either of those “other” benefits. For one thing, unlike Social Security Disability, under FERS Disability Retirement, a Federal or Postal employee does not have to be “totally disabled”, but merely prove that you are no longer able to perform one or more of the essential elements of one’s Federal or Postal job. Second, unlike Worker’s Compensation (or otherwise known as OWCP), the injury or medical condition does not have to be “work-related”. In other words, you do not have to prove “causation” in order to qualify for Federal Disability Retirement benefits under FERS.
As each individual suffers from a medical condition unique to his or her personal circumstances, so the approach that an applicant for Federal Disability Retirement benefits must take should specifically address such individual circumstances. I am an attorney who specializes exclusively in representing Federal and Postal employees at all stages of the process — from the initial stage, where a persuasive and compelling presentation to the U.S. Office of Personnel Management must be carefully prepared and formulated; to the Second Stage — the “Reconsideration Stage” — where rebuttal evidence and further legal argumentation may be submitted; to the Third Stage — an Appeal to the U.S. Merit Systems Protection Board before an Administrative Judge via a telephonic Hearing — my representation is tailored to the individual needs unique to each situation.
All Federal employees and Postal workers who are thinking about filing for Federal Disability Retirement benefits under FERS through the U.S. Office of Personnel Management should first consult with an experienced attorney who specializes exclusively in Federal Disability Retirement Law. For a free initial consultation, contact me at 1-800-990-7932, or email me at federal.lawyer@yahoo.com.
Sincerely,
Robert R. McGill, Esquire
Federal Disability Attorney
There is that moment of haziness, where sleep has not yet overtaken and consciousness has not yet been fully lost, where the philosophical abyss of Kierkegaard’s Either/Or stands in relation to knowledge, truth, insight and puzzlement, and where questions abound concerning the relationship between words and the objective reality of constellations clashing amidst bursting stars and black holes.
Sleep is a realm sought after; restorative sleep, a state of being which, without explanation or cause, we accept as a necessity of life’s conundrums. Without it, or because of a lack thereof, functionality deteriorates, awareness becomes overwhelming, and the capacity to tolerate a normal level of life’s stresses becomes an issue of sensitivity and tearful breakdowns. Sleep brings us to the other side of darkness; wakefulness, this side of paradise.
Whether because our genetic code has not yet adapted fully through the evolutionary process of survivability, or that technology outpaces the capacity of human intelligence to withstand the constant bombardment of stimuli upon organic receptors devised merely for hunting or gathering, we may never figure out. Regardless, many are like the sleeping dead, where the netherworld between sleep and wakefulness remain unchanged, and profound fatigue, daily exhaustion and untenable mental fogginess and loss of intellectual acuity impacts one’s daily ability and capacity to make a living.
For Federal employees and U.S. Postal workers who must contend with such an exacerbating and complex state of health, the reality of going through the day, of coming home exhausted and forlorn, yet unable to turn that profound fatigue into a period of respite and restorative sleep, is a reality faced with the concerns of being able to continue in one’s Federal or Postal career.
Sleep disorders are often secondary medical and health issues, following upon primary physical and psychiatric disabilities; but they can also be a primary basis for preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.
Whether diagnosed as Sleep Apnea, Insomnia, or a more generalized diagnosis of Sleep Dysfunction or Sleep Disorder, the impact upon one’s cognitive acuity as well as the physical exhaustion felt, which can lead to creating a hazardous workplace phenomena, the Federal or Postal employee who finds that the impact prevents him or her from performing one or more of the essential elements of one’s Federal or Postal positional duties, should consider that the health issue itself is a valid one, and a firm basis for preparing, formulating and filing for Federal Disability Retirement benefits through OPM.
One may, here and there, experience the phenomenon of entering that netherworld between the dark chasm of sleep and the full orientation of wakefulness, and know that drifting between one and the other is likened to the necromancy of human complexity; but when such a condition remains a constancy in one’s life, then it may be time to consider filing for a Federal Disability Retirement annuity, lest the sorcery of life’s dreamworld waves the wand which withers the soul.
Sincerely,
Robert R. McGill, Esquire

Prognostication of weather, beyond a day (or sometimes a couple of hours) can be treacherous and self-defeating. With enhanced computer networks which reevaluate information as it is fed with information concerning patterns of predictability, shifting atmospheric changes and spectrums of barometric alterations; cumulatively, a pie in the face is preferable despite advanced technologies allowing for respectable predictability.
Similarly, the medical field is expected to provide predictions of future events and as-yet unforeseen consequences. Because medicine is considered a “science”, the level of accuracy is required beyond mere witch’s brew, or the spell of waved wand cast upon an unsuspecting eye. Thus do doctors engage in percentages and probabilities; of mortality, X-percentage, give or take a few months, based upon studies delineated in some obscure journal presumably respected and hidden in the esoteric towers of ivory bastions.
For Federal employees and U.S. Postal workers who are contemplating filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the requirement for Federal and Postal employees includes information that the medical condition will last a minimum of 12 months (from the date of filing for Federal Disability Retirement). Persistent and prevalent misinterpretation of this requirement pervades; one often hears the belief that the Federal or Postal employee must be away from work, or otherwise incapacitated, for that period of 12 months before filing. Nothing could be further from the truth.
The requirement is merely one which denotes a prognosis or prediction, no more than what the medical field can predict and what the weather can portend. It merely means that a Federal or Postal employee who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal positional duties, will be so prevented and impacted for a minimum of 12 months.
Any doctor worth his or her salt can provide a prognosis of how long the medical condition will last, and whether or not such a prognosis is as accurate as the 10-day forecast promulgated by weather entities is often irrelevant. For, in the end, the Federal or Postal employee who suffers from the medical condition and who needs to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, knows in his or her “heart of hearts” how long the medical condition will last, whether it is for a day or a season, or a lifetime of chronicity requiring longterm care and treatment.
As one’s own body, mind and soul rarely mistakes the shifting changes of life, so the weather and prognosis of one’s own health can be established through the experience of pain, agony, and the pounding of deterioration perpetrated upon the vulnerability of a mortal being.
Sincerely,
Robert R. McGill, Esquire

It is often quipped that the advantage of human psychology is in our short memories; otherwise, we would walk around with greater angst than we deserve. The accomplishments achieved; the accolades left unstated; perhaps in menial tasks or ones of recognized significance; but in any event, a career, all told, which spans a decade or more, will always have a sense of achievement, if only for the steadfastness of commitment itself.
In this day and age, where millennials change jobs as often as infants of diapers, the career of a Federal or Postal worker which spans multiple decades is an anomaly itself. Whether the goal was to make that 30 years, or simply because the Federal or Postal employee liked what he or she was doing, matters not.
Commitment in and of itself is an achievement.
Thus, when a Federal employee’s or a U.S. Postal worker’s career is cut short because of a medical condition, such that the medical condition necessitates the filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management (OPM), whether the Federal employee or Postal worker is under FERS, CSRS or CSRS Offset, the regrets foretold or the dismay of a career cut short, should always be replaced with memories from whence we came.
Staying with a Federal or Postal job for so many years reveals a steadfastness of purpose; but where priorities intersect and interrupt, especially when it comes to one’s health and future security, filing for OPM Medical Retirement benefits is meant to salvage such a career by allowing for an annuity to stabilize one’s future, and to consider taking that experience one has amassed into the private sector for a possible second vocation.
Memories; they are funny animals; and for humans, allows for visualization and imagination from whence we came.
Sincerely,
Robert R. McGill, Esquire
